Welcome to PawpicAI.com, owned and operated by PawpicAI. These Terms & Conditions govern your access to and use of our website, and the AI pet portrait generation services offered through this Site.
Please read these Terms carefully before using our Services. By accessing or using the Site or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, do not use the Site or Services.
1. Description of Services
PawpicAI provides a service that allows users to upload approximately ten to twenty images of their pet. We then use these images to fine-tune a custom Lora model specific to that pet. Using this Lora model and other AI technologies, we generate unique AI-powered portrait photos of the pet.
2. User Accounts & Eligibility
You must be at least 18 years old to use our Services.
You may be required to create an account or provide an email address to use certain features of the Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account password and for any activities or actions under your account.
3. User-Uploaded Content
Your Rights: You retain all ownership rights to the original pet photos you upload (“User Content”).
License to PawpicAI: By uploading User Content, you grant PawpicAI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify (e.g., to create the Lora model and Generated Art), and process the User Content solely for the purposes of:
Providing the Services to you, including generating the Lora model and the Generated Art.
Improving our AI models and Services (primarily through the fine-tuned Lora model created for your pet, which may contribute to our understanding of pet features for general model improvement. We will strive to use such data in an aggregated or anonymized form where feasible for general model improvement).
User Representations and Warranties: You represent and warrant that:You own or have the necessary licenses, rights, consents, and permissions to submit the User Content and to grant PawpicAI the license set forth above.
The User Content does not infringe upon, misappropriate, or violate any third party’s intellectual property rights, rights of publicity or privacy, or any applicable law or regulation.
4. Generated Art
Ownership & License: Upon successful generation and delivery of the Generated Art to you, PawpicAI grants you a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute the Generated Art for your personal, non-commercial purposes.
Commercial Use: If you wish to use the Generated Art for commercial purposes, please contact us to discuss licensing options.
No Guarantees: AI art generation is an evolving field. While we strive to create high-quality portraits, we do not guarantee specific results, likeness, or artistic styles. The quality of the Generated Art is highly dependent on the quality and variety of the User Content provided.
5. Payment and Fees
If our Services require payment, you agree to pay all applicable fees as described on the Site in connection with such Services selected by you.
All fees are non-refundable except as expressly stated in these Terms or as required by applicable law.
We use third-party payment processors to handle payments. Your payment information is subject to the terms and privacy policies of these processors.
6. Prohibited Conduct
You agree not to:
Upload any User Content that is illegal, harmful, defamatory, obscene, infringing, or otherwise objectionable.
Use the Services for any illegal or unauthorized purpose.
Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
Attempt to gain unauthorized access to the Services or its related systems or networks.
Use any automated system, including “robots,” “spiders,” or “offline readers,” to access the Services in a manner that sends more request messages to the PawpicAI servers than a human can reasonably produce in the same period by using a conventional web browser.
7. Intellectual Property of PawpicAI
Excluding User Content and Generated Art (as licensed to you), all content on the Site and Services, including text, graphics, logos, icons, images, AI models (excluding user-specific fine-tuned Lora models derived directly from your User Content for your exclusive use), software, and the arrangement thereof, is the property of PawpicAI or its licensors and is protected by copyright, trademark, and other intellectual property laws.
8. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
9. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. PAWPICAI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAWPICAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
11. Indemnification
You agree to defend, indemnify, and hold harmless PawpicAI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) User Content posted on the Service.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
